PaddleRack LLC ("we," "us," or "our") operates the PaddleRack mobile application (the "App"). We are committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our App.

1. Information We Collect

We collect information you provide directly to us when you create an account, build a profile, or use our matchmaking services:

• Personal Identifiable Information: Name, Email Address, and Date of Birth.
• Profile Information: Gender and skill ratings (including peer-submitted ratings).
• Location Data: With your explicit permission, we collect precise or coarse geolocation data from your mobile device to display nearby sessions and players.

2. How We Use Your Information

We use the collected data to:

• Create, maintain, securely authenticate, and manage your user account.
• Facilitate localized pickleball matchmaking.
• Verify adult age eligibility (18+).
• Transactional Communications: Send essential system alerts, password resets, security notices, administrative messages, or customer support responses related to your account.
• Marketing Communications: Send updates about new platform features, community news, promotional offers, or relevant affiliate marketing materials.

3. Your Communications Choices (Opt-Out)

We respect your preferences regarding communications:

• Transactional Emails: Because these are strictly necessary for account security, verification, and core functionality, you cannot opt out of receiving transactional or administrative emails while your account remains active.
• Marketing Emails: You can opt out of receiving our marketing and promotional emails at any time by clicking the "unsubscribe" link found at the bottom of any marketing email we send. Once you opt out, we will promptly remove you from our marketing distribution lists.

4. Data Sharing and Disclosure

We do not sell your personal data or email addresses to third parties. Your information is shared only in the following ways:

• With Other Users: Your name, gender, approximate location, and skill level are visible to other users on the platform to facilitate matchmaking. Your email address, exact continuous location, and precise date of birth are strictly kept private and are never exposed to other users.
• Legal Obligations: We may disclose your information if required to do so by law, court order, or to protect the safety, property, or rights of PaddleRack LLC, our users, or the public.

5. Data Retention and Deletion

We retain your personal information only as long as your account is active. You may request the deletion of your account and all associated personal data (including your email address) at any time by navigating to your account settings or contacting us at admin@thepaddlerack.com. Residual data (such as anonymized peer ratings you submitted) may remain aggregated and de-identified.

6. Age Restrictions and Privacy

PaddleRack is intended strictly for users who are at least 18 years of age. We do not knowingly collect or solicit personal information from anyone under the age of 18. If we discover that an individual under 18 has created an account or provided us with personal data, we will terminate the account and delete the associated data immediately.

Welcome to PaddleRack (the “App”). By downloading, accessing, or using our mobile application, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

1. Eligibility and Account Security

• Age Restriction: You must be at least 18 years of age to create an account, use PaddleRack, or participate in any matches organized through the platform. By creating an account, you represent and warrant that you are an adult of legal age.
• Account Accuracy: You agree to provide accurate, current, and complete information during registration (Name, Gender, Date of Birth). You are responsible for safeguarding your account credentials.
• Single Account: Users are permitted to maintain only one active account. Automated account creation (bots) is strictly prohibited.

2. User Conduct and Community Standards

PaddleRack is designed to foster a fair and respectful pickleball community. You agree not to:

• Provide fraudulent, inaccurate, or intentionally misleading self-reported skill levels.
• Harass, abuse, threaten, or intimidate other players or community members.
• Misuse the anonymous peer-rating system to maliciously degrade or falsely inflate another user’s standing.
• Use the App for any illegal, unauthorized, or commercial solicitation purposes.

We reserve the right, at our sole discretion, to suspend or terminate accounts that violate these community standards.

3. Location-Based Services

The App relies on location services to function effectively. By enabling location permissions on your mobile device, you acknowledge that the accuracy of matchmaking depends heavily on this data. You can revoke location access at any time through your device settings, acknowledging that doing so will break core app functionalities.

4. Intellectual Property

All rights, titles, and interests in the App, including layout, custom widgets, graphics, code, and branding elements, are the exclusive property of PaddleRack LLC. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App solely for personal, non-commercial use.

5. Disclaimers and Limitation of Liability

• "As-Is" Service: PaddleRack is provided on an "as-is" and "as-available" basis without warranties of any kind, express or implied.
• Physical Safety: Pickleball involves physical exertion. PaddleRack LLC is a matchmaking platform and is not liable for any physical injuries, medical emergencies, property damage, or personal disputes that occur during matches, at physical courts, or during interactions arranged through the App.
• Limitation of Damages: To the maximum extent permitted by law, PaddleRack LLC shall not be liable for any indirect, incidental, special, or consequential damages arising out of your use or inability to use the App.

6. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law principles. Any legal actions or proceedings arising under these Terms shall be brought exclusively in the state or federal courts located in Ohio.
